Terms and Conditions

1. Acceptance of Terms

By registering for an account and using the TCC Car Auctions platform ("Platform"), you ("Dealer", "you", or "user") agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree, please do not register or use the Platform.

2. Dealer Eligibility

To register as a Dealer, you must:

• Be legally authorized to buy cars or be a licensed car dealer in the UAE.
• Provide accurate and up-to-date identity or trade license information.
• Be legally authorized to enter into binding contracts.

We reserve the right to verify your identity or dealer credentials and to accept or reject any registration without notice or explanation.

3. Auction Participation

• Bidding: Only registered and approved Dealers may place bids.
• Binding Bids: All bids are considered legally binding offers to purchase the listed vehicle at the bid price made by you on the Auction Application.
• Winning Bids: If your price is the highest at the closing of the auction, or you clicked the buy-now button, then you have won the auction. If you win an auction, you are obligated to complete the purchase within the specified time frame and payment terms.

4. Auction Types

• Reserve Auctions: All our auctions are reserved auctions by default unless otherwise highlighted. The vehicle will not be sold unless the car owner's reserve price is met. This reserve price is confidential to the car owner.
• Non-Reserve Auctions: The vehicle is sold to the highest bidder regardless of value.
• Buy-Now Option: Any auction that includes a Buy-Now button can be won directly by clicking the Buy-Now button, and your car price will be the price shown in that button.

5. Payments and Fees

• Payment must be made within 24 hours of winning an auction.
• All prices are exclusive of VAT, registration fees, or transport costs unless stated otherwise.
• Late payments may result in penalties or account suspension.

6. Vehicle Condition and Inspections

• All vehicles are sold as-is with available inspection reports.
• We are not liable for undisclosed vehicle defects after purchase.

7. Dealer Conduct and Prohibited Use

You agree not to:

• Misrepresent your business, yourself, or place false bids. All bids are binding agreements.
• Attempt to manipulate auction outcomes.
• Engage in abusive, threatening, or fraudulent behavior.
• Circumvent the Platform to buy vehicles off-platform. Legal action may be taken, and a commission of 20% of the car price may be charged to the dealer as a penalty on the bought car.

We reserve the right to suspend or terminate accounts that violate these conditions.

8. Intellectual Property

All content on the Platform, including design, logos, listings, images, and text, is owned and licensed by TCC Portal LLC and may not be copied, reproduced, or used without our express written consent.

9. Termination

We may suspend or terminate your account without notice if you breach these terms or misuse the Platform.

10. Limitation of Liability

We provide the Platform on an "as is" basis. We are not liable for any direct, indirect, or consequential damages resulting from use of the Platform, missed auctions, or vehicle conditions.

11. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the United Arab Emirates. Any disputes arising under or in connection with these Terms shall be resolved through amicable negotiation, and if unresolved, referred to Dubai Courts.
